Terms of Service

These Terms of Service ("Terms") govern the use of the WhatStats application ("the App"), developed by Lorenzo Meccoli ("we"). By using the App, you agree to these Terms.

1. Description of the service

WhatStats analyses WhatsApp chat exports to generate statistics, charts, and AI-powered analyses. Local statistics are calculated entirely on your device. AI features require sending aggregate data to our servers for processing.

2. User responsibilities

• You are responsible for the content you import into the App. Only import chats in which you are a participant.
• We recommend informing other chat participants before analysing a conversation with AI features, out of respect for their privacy.
• Do not use the App for unlawful purposes or in violation of third-party rights.
• Do not attempt to manipulate, decompile, or interfere with the operation of the App or its servers.

3. Premium Subscription

• The Premium subscription is managed through the Apple App Store and renews automatically.
• You can cancel automatic renewal from your device's Settings → Apple ID → Subscriptions, at least 24 hours before the end of the current period.
• Refunds are managed exclusively by Apple according to their terms of sale.
• The Premium subscription includes a limited number of monthly AI credits, as indicated in the App at the time of purchase.

4. AI Credits

• AI credits are consumable purchases that allow you to use the AI chat features (Ask Your Chat).
• Each AI question consumes 1 credit.
• Purchased credits do not expire and remain available until used.
• Credits are associated with your device and synced via iCloud. Changing your Apple ID or disabling iCloud may result in the loss of credits.
• Used credits are non-refundable. For unused credits, refunds follow Apple's policies.

5. Referral Program

• Each user receives a unique referral code.
• When a new user redeems your code, both of you receive 3 free AI credits.
• Each device can redeem only one referral code, and each code can only be redeemed once per device.
• Creating multiple accounts, using virtual devices, or other methods to fraudulently obtain credits is not permitted.
• We reserve the right to modify, suspend, or terminate the referral program at any time, and to revoke fraudulently obtained credits.

6. AI-generated content

• Analyses, reports, DNA profiles, and question answers are automatically generated by artificial intelligence.
• AI content is provided for entertainment purposes and does not constitute psychological, legal, or professional advice of any kind.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content. Interpretations may contain inaccuracies or errors.
• We are not responsible for decisions made based on AI-generated content.

7. Intellectual property

The App, its design, code, and content are the property of Lorenzo Meccoli. Users retain all rights to their personal data and imported chats. Analysis results generated by the App may be freely shared by the user.

8. Limitation of liability

• The App is provided "as is", without warranties of any kind.
• We are not responsible for data loss, service interruptions, or indirect damages arising from the use of the App.
• Our total liability is limited to the amount paid by the user in the last 12 months.

9. Service availability

AI features depend on the availability of our servers and the AI provider (Anthropic). We reserve the right to temporarily suspend the service for maintenance or updates. In the event of AI service discontinuity, local statistics features will continue to function normally.

10. Changes to the Terms

We may update these Terms. Substantial changes will be communicated through the App. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Governing law

These Terms are governed by Italian law. For any dispute, the Court of Rome shall have jurisdiction, without prejudice to the mandatory rights of the consumer under the Italian Consumer Code (Legislative Decree 206/2005).
