Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Closr mobile application ("the App") operated by Matko Setnik ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old. We do not knowingly allow use by anyone under 18.

2. Account Registration

• You may create an account using your email address, Google account, or Apple ID.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

3. Description of Service

Closr is a relationship wellness application that helps couples and individuals improve communication about intimacy, rediscover desire, and strengthen their connection through:

• Guided prompts and conversation starters
• Daily check-ins for self-reflection
• Relationship exercises with step-by-step guidance
• Multi-day programs for deeper exploration
• Private journaling
• Love letters between partners
• Date night planning
• Relationship insights and compatibility scores

4. Partner Pairing

• The App allows you to pair with a partner using an invite code.
• By pairing with a partner, you consent to sharing certain information with them as described in our Privacy Policy, including your display name, avatar, aggregated check-in summaries, activity streaks, compatibility scores, date night plans, and love letters you send.
• You may use the App in solo mode without pairing with a partner.
• You should only pair with someone who has given their consent to participate.

5. Subscriptions and Payments

5.1 Free and Premium Features

The App offers both free and premium features. Premium features require an active subscription.

5.2 Billing

• Subscriptions are billed through the Apple App Store or Google Play Store, depending on your device.
• Payment is charged to your App Store or Play Store account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.

5.3 Cancellation

• You may cancel your subscription at any time through your App Store or Play Store account settings.
• Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date.
• We do not provide refunds for partial billing periods.

5.4 Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of your next billing period following notice of the change.

6. User Content

6.1 Your Content

You retain ownership of all content you create within the App, including journal entries, love letters, custom prompts, and date night plans ("User Content").

6.2 License to Us

By creating User Content, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the App's services to you and your paired partner (where applicable).

6.3 Content Guidelines

You agree not to create or share content that:

• Is unlawful, threatening, abusive, harassing, or harmful
• Violates the rights of any third party
• Contains malicious code or attempts to interfere with the App's operation
• Impersonates any person or entity
• Is used to harass, stalk, or intimidate another person

7. Intellectual Property

All content provided by the App — including prompts, exercises, programs, illustrations, and user interface design — is the intellectual property of Matko Setnik and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or publicly display any App content without prior written permission.

8. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to the App's systems or other users' accounts
• Reverse engineer, decompile, or disassemble the App
• Use the App to collect personal information about other users without their consent
• Use automated systems (bots, scrapers) to access the App
• Interfere with or disrupt the App's infrastructure
• Share your account credentials with others

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the App, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers

10.1 No Professional Advice

The App provides relationship wellness content for informational and educational purposes only. It does not constitute professional therapy, counseling, medical advice, or mental health treatment. Always seek the guidance of a qualified professional for relationship or mental health concerns.

10.2 As-Is Basis

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.3 No Guarantee of Results

We do not guarantee that using the App will improve your relationship or produce any specific outcome. Individual experiences may vary.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Matko Setnik shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of the App's availability
• Any content or conduct of any third party within the App

In no event shall our total liability to you exceed the amount you have paid us in the twelve (12) months prior to the claim.

12. Account Termination

12.1 By You

You may delete your account at any time through the App's settings or by contacting us at hello@mcode.hr. Upon deletion, your personal data will be permanently removed in accordance with our Privacy Policy.

12.2 By Us

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, us, or third parties. We will make reasonable efforts to notify you prior to termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Republic of Croatia.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms within the App and updating the "Effective Date" above. Your continued use of the App after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Matko Setnik regarding your use of the App and supersede all prior agreements and understandings.
