    What does this privacy policy cover?

    This Privacy Policy applies only to information collected on or after the Last Updated date of this Privacy Policy and only to information collected by the Punch app (“App” or “We”). It does not apply to any other information collected by Punch, Inc. (“Punch”, “we” “us” or “our) through any other means, including information that may be collected by Punch offline. Nor does it apply to any other websites or online services maintained by Punch or by any of Punch’s affiliates. Finally, this Privacy Policy does not apply to any websites or other online services maintained by other companies or organizations to which the App links. Punch is not responsible for the content or activities provided on those websites or other online services. We encourage you to review the privacy policies of all third parties and exercise caution in connection with them, particularly when providing personal information to those third parties.

    About Us

    Punch is an experience that guides and allows users to create short form comedic sketch videos and share them with friends and contacts through the App and social media channels (“Services” or “Platform”).

    What information do We collect about you?

    We may collect and use the following information about you:

    Personal information provided by you in the course of using our Services include the following:

    Social Sharing

    For users above 13 have the ability to share their videos through social channels, email and text message through Apple Share features on iOS. Once you share content on a third-party social platform, their privacy policy applies. For further information as to how and for what purpose the social network provider processes your data, please see the privacy policies of these social network providers.

    Device settings 

    We automatically collect certain information from you when you use the Platform, including your IP address, general location-related data (as described below) or other unique device identifiers, (also called persistent identifiers), content you have viewed in the Platform, your mobile carrier, time zone setting, mobile or device information including the model of your device, your screen resolution, operating system and platform and information regarding your use of the Platform. We use Google Analytics to collect such information. See more information on Google Analytics below.

    Behavioral information 

    We also collect information regarding your use of the Services, e.g. user-generated content and video content that you generate through and broadcast on our Platform. We do not collect behavioral information for advertising purposes.

    Location data

    When you use the Platform on a mobile device, we may collect information about your location. With your permission, we may also collect Global Positioning System (GPS) data and mobile device location information for the purpose of personalizing your experience, for example setting the language of where you are located.

    Measurement and analytics

  1. We use third-party analytics tools to help us measure users and usage trends for the Services. These tools, for example, collect information including the pages you visit, time spent on each page, and other information. This information assists us in improving the Platform and provide our Services in accordance with these activities.
  2. Our third-party analytics tool is Google Analytics provided by Google, Inc (1600 Amphitheatre Parkway Mountain View, CA 94043, USA). Google Analytics uses device identifiers, like a UDID. Google will use this information including your truncated IP address to assemble statistics on the use of our Service or to provide other related services as described above. You can also find further information in the Google Analytics Terms of Service & Privacy. Information collected through Google Analytics is not used for advertising purposes.
  3. Who do we share your information with?

    Children

    We are committed to compliance with the Children’s Online Privacy Protection Act (“COPPA”), a federal law designed to protect Children online, and other laws focused on protection of Children’s personal information. We take Children's privacy seriously and encourage parents to take an active role in protecting their Children's privacy and online experience at all times.

    Collection and Use of Children's Personal Information

    We may collect and store persistent identifiers (e.g., cookies, IP addresses, Device ID etc.) from Children without parental consent for the purpose of supporting the internal operations of the Service or as otherwise permitted under COPPA.

    We may ask users to verify their date of birth before collecting any personal information from them. Those users that indicate they are Children (under 13 in the United States generally, are taken to a version of our Platform that does not collect any personal information except for the support of internal operations. While Children are still able to use an alternate version of the Platform, that version does not store any video, audio/microphone, camera or other information, except information used for internal operations, on the backend App servers. Audio and video files are stored locally on the user’s device. Social sharing features through Apple Share are not available for Children.

    If you think your child may have submitted their personal information to us by mistake, please let us know, legal@trypunch.com  and we will delete that data.

    Please note that we use aggregated (i.e., non-personal) information for analytics purposes.

    What are my information choices?

    Personal Information

    We do not ask that you provide us with any personal information. However, if you have questions about what information has been collected about you, you may contact support@trypunch.com.

    Regarding persistent identifiers used for advertising:

    We do not collect data for the purposes of interest-based advertising, and do not permit our partners to collect data for purposes of interest-based advertising.

    Regarding Promotional Communications

    You may opt out of receiving promotional emails, text messages or mail from the Platform by declining to receive such communications at the time you create a profile or at the time you otherwise indicate to us to wish to opt out. You may also opt-out of receiving promotional emails or text messages by following the instructions in those emails or text messages or by sending an email to support@trypunch.com.

    If you opt out, we may still send you transactional or relationship messages, such as emails about your account or profile or our ongoing business relations.

    Security

    Punch has established policies in an effort to protect your personal information against loss, misuse and unauthorized access, disclosure, alteration and/or destruction. For example, we provide only those employees performing a legitimate business function with access to users’ personal information. We also review our security procedures periodically to consider appropriate new technology and updated methods.

    Despite our efforts, please be aware that no security measure is ever perfect or impenetrable. Because no security method is 100% secure, please be do not share Personal Information online, or include any Personal Information in public forums. To that end, we will notify users of a data breach in accordance with applicable law.

    How long will we hold your information?

    We retain your information for business purposes, and/or as long as is reasonably necessary to provide you with our Services. We will also retain your information as reasonably necessary to comply with our legal obligations, resolve disputes and enforce our agreements. We may also retain cached or archived copies of your information for a reasonable period of time.
