These Terms of Use ("Terms") govern your use of the MiaLuna iOS application and related services (collectively, the "Service"). By using MiaLuna, you agree to these Terms.

1. Eligibility and Acceptance

You must be at least 13 years old to use MiaLuna.
If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.
If you do not agree to these Terms, do not use the Service.

2. Your Account

MiaLuna currently runs in local mode on your device and does not offer a separate sign-in flow.
You are responsible for maintaining the confidentiality and security of your device access.
If you contact support, you agree to provide accurate information needed to help resolve your request.

3. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use MiaLuna for personal, non-commercial purposes on Apple-branded devices you own or control, as permitted by Apple's Usage Rules.

4. User Content

You retain ownership of the content you submit (including dream entries and notes).
You grant us a limited license to host, process, store, and transmit your content solely to operate and improve the Service.
You represent that you have rights to submit the content and that it does not violate law or third-party rights.

5. AI Features and Disclaimers

MiaLuna includes AI-generated interpretations and images. Outputs may be inaccurate, incomplete, or subjective.
The Service is for journaling, reflection, and entertainment purposes.
The Service does not provide medical, psychological, legal, or financial advice. Do not rely on it for emergency or professional decisions.

6. Prohibited Conduct

You agree not to:

Use the Service in any unlawful, harmful, abusive, fraudulent, or infringing manner.
Attempt to access systems or data you are not authorized to access.
Interfere with or disrupt the Service, including abuse of APIs or automated scraping.
Reverse engineer the Service except where prohibited by applicable law.

7. Subscriptions, Free Trials, and Billing (Apple In-App Purchase)

Some features require a paid subscription.
At launch, plans may include weekly and monthly options, and a free trial may be offered. Final price and duration are displayed in-app before purchase.
Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours before the end of the current period.
You can manage or cancel subscriptions in your Apple ID Account Settings after purchase.
Any unused portion of a free trial (if offered) is forfeited when you purchase a subscription.

8. Refunds and Purchase Restoration

Apple manages billing and refunds for in-app purchases made through the App Store.
For refund requests, contact Apple Support directly.
You may restore eligible purchases using the in-app restore flow.

9. Third-Party Services

MiaLuna may rely on third-party providers (for example backend infrastructure, analytics, AI processing, and subscription tooling). Your use of third-party capabilities may also be subject to those providers' terms and policies.

10. Intellectual Property

The Service, including software, branding, text, graphics, and other materials (excluding your content), is owned by MiaLuna and its licensors and protected by applicable intellectual property laws.

11. Service Availability and Changes

We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice, including updates to features, pricing, or functionality.

12. Termination

We may suspend or terminate access to the Service if you violate these Terms or if required for security, legal, or operational reasons. Sections that by nature should survive termination will survive.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAMS AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE ARISING FROM OR RELATED TO THE SERVICE.

15. Governing Law

These Terms are governed by applicable laws in the jurisdiction where the Service operator is established, without regard to conflict-of-law principles, except where consumer protection law requires otherwise.

16. Apple-Specific Terms

These Terms are between you and MiaLuna, not Apple.
Apple has no obligation to provide maintenance or support for the Service.
Apple is not responsible for claims relating to the Service except as required by law.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Changes to These Terms

We may revise these Terms from time to time. If we do, we will post the updated Terms with a new effective date. Continued use of the Service after updates means you accept the revised Terms.
