We at NiceWalk respect your privacy. We are glad to tell you more about which data is accessed, how it is used, and which services we use to enhance your NiceWalk experience.

INFORMATION WE MAY COLLECT FROM YOU

From time to time, we may collect or ask you to provide personal information including (without limitation) the following: your name, mobile phone number, email address, password, IP address, unique device identifiers and other identification credentials, biographical details, photographs and/or payment information.

As part of the Services, we may provide functionality allowing you to search for friends by using your Facebook credentials and, when you elect to do this, you will be asked to allow the NiceWalk App to access certain information associated with your Facebook account such as your name, profile picture, gender and list of friends. Provided you consent to this, such information will be processed by us in order to identify your Facebook friends who are users of NiceWalk App and to allow you to invite those Facebook friends to install the NiceWalk App.

Please note that, with your consent, we will collect information about your location and physical movements in order for the NiceWalk App to function properly and monitor and verify forms of eligible movement. You may turn location monitoring on and off from time to time using the settings of your operating system of your mobile device but, if you disable this functionality, we will not be able to collect information relating to your step-count and GPS/Cell-ID location which will prevent tracking and/or conversion of your movement into NiceWalks.

We work with third parties from time to time (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers and credit reference agencies) who may provide to us information about you. This may include your purchase history from business partners who supply you with rewards made available via the NiceWalk App.

USES MADE OF YOUR PERSONAL DATA

We may use your personal data to:

l To provide the Services

We use the information we collect and receive to provide the Services. This includes health and wellness data tracking, location tracking for outdoor activities, presentation of your health and wellness data in historical trends and relative to other users, guided fitness programs, participation in our online virtual challenges and races, and participation in our online community.

l To provide recommendations

We use the information we collect about you, your followers, and your activities to make recommendations to you while you are using our services. For example, we may recommend workout programs, other NiceWalk members to follow, routes to explore, groups to join, or new challenges to enter.

l To protect you and the Services

We use the information we collect to enforce our Terms of Service and Community Standards, and to protect you and the Services from malicious behavior.

l To improve the Services

We use the information we collect to improve the Services. This includes a thorough analysis of product usage and technical logs.

l To communicate with you by email

We use the information we collect to provide support in response to your customer support requests or sales inquiries.

We may also, with your consent, send you push notifications or emails that are promotional in nature. You must opt in to join our email list, and you can opt out at any time by clicking or tapping the unsubscribe button at the bottom of each email communication.

l To communicate with you by push notification

We use the information we collect to send push notifications to your registered devices if you provide permission to do so. Notifications may be promotional in nature. You may revoke our permission to send you push notifications at any time from your device settings. The NiceWalk settings also provide fine-tuned notification preferences if you wish to turn on or off only some types of notifications.

l To process your subscription

We use the information we collect to process your subscription.

l To create aggregated data for use in the Services

We use the information we collect to create aggregated and anonymized data for use in the Services.

This includes our “Benchmarks” feature which allows you to compare your daily activity levels to general demographic populations grouped by age, gender, geographic region and BMI.

This also includes our “Routes” feature, which combines GPS routes submitted by users with publicly shared GPS tracks to create a database of the most-used walking, running and hiking routes in each area.

WE MAY UPDATE THIS PRIVACY POLICY

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.

You have the right to make a complaint at any time to your local data protection authority if you have concerns regarding your rights under applicable law. We would, however, appreciate the chance to address your concerns so please contact us first so that we can discuss a resolution with you directly.
