Terms of Service
Effective Date: September 1, 2026
Welcome to Know Your Dirt (the "App"). These Terms of Service ("Terms") govern your access to and use of our mobile/web application, our physical testing tool, and our related subscription services (collectively, the "Services") provided by Know Your Dirt ("we," "us," or "our"). By purchasing our physical tool, activating an account, or using the App, you agree to be bound by these Terms. If you do not agree, do not use our Services.
1. Description of Services
Our App provides conceptual tent layout drawings generated from user-provided inputs and physical soil testing metrics. To utilize the Services, users must purchase our custom physical testing hardware (the "Hardware Tool") and maintain an active subscription.
2. Eligibility and License
- Eligibility: You must be at least 18 years old and capable of forming a binding contract to use our Services.
- License Grant: Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for your professional or personal tent planning operations.
3. Physical Hardware and Shipping
- Purchase and Delivery: Purchase of the Hardware Tool requires a valid shipping address. Risk of loss and title for the physical tool pass to you upon our delivery to our shipping carrier (e.g., USPS, FedEx, UPS).
- Equipment Use: The Hardware Tool is to be used solely in accordance with its provided documentation and safety instructions. We are not responsible for any personal injury or property damage resulting from misuse or structural negligence during field testing.
4. Subscription Plans, Introductory Offer, and Billing
Account activation connects the Hardware Tool purchase to App access, the introductory free period, and the renewal plan selected by the user.
4.1 Introductory Offer
Your purchase of the physical Hardware Tool includes an introductory period consisting of six (6) months of free subscription access to the App, starting from the date of activation.
4.2 Plan Selection at Activation
To complete the activation of your App account, you will be prompted to select your preferred post-trial renewal plan:
- Monthly Subscription Billing Cycle
- Annual Subscription Billing Cycle
You may change your plan selection at any time during your 6-month free introductory period through your account settings.
4.3 Automatic Renewal and Fees
Upon the expiration of the 6-month free introductory period, your chosen subscription plan (monthly or annual) will automatically renew, and you will be billed the standard subscription fee using the payment method on file.
- Cancellation Window: To avoid being charged for the paid renewal cycle, you must cancel your subscription at least three (3) days prior to the expiration of the 6-month introductory period.
- Subsequent Renewals: Following the introductory period, subscriptions automatically renew on your chosen cadence (monthly or annually) unless canceled before the next billing date.
4.4 Third-Party Payment Processing
All financial transactions, billing, and subscription payments are handled securely through our third-party payment processors (e.g., Stripe, Quicken). We do not store your credit card numbers or financial credentials on our servers.
5. App Inputs and Intellectual Property
- Your Inputs: You retain ownership over the raw dimensions and data you input into the App.
- App Content: We retain full ownership, intellectual property rights, and copyright over the App's underlying software, algorithms, design logic, interface elements, and the mathematical framework used to generate the layout drawings.
- Output Rights: You are granted a license to use, and distribute the generated layout drawings to your Installers for planning and event setup purposes.
6. Disclaimer of Liability (Crucial Planning Notice)
- Conceptual Planning Only: The tent layout drawings generated by this App are for reference purposes only.
- No Engineering Guarantee: The App's calculations do not replace certified structural engineering, local building codes, or professional manufacturer anchoring guides.
- Limitation of Liability: To the maximum extent permitted by law, Know Your Dirt shall not be liable for any real-world site setup failures, tent collapses, staking errors, structural damage, permitting issues, or physical injuries resulting from reliance on the layouts or the data obtained from the physical Hardware Tool.
7. Termination
We reserve the right to suspend or terminate your account and access to the App if you violate these Terms, fail to pay subscription fees, or use the Services in an unauthorized or hazardous manner.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Wisconsin, United States of America, without regard to its conflict of law provisions.
