Welcome to the LetzTrip mobile application (the "Application"). The Application is owned, operated, and provided by PIRTZTEL TECHNOLOGIES PRIVATE LIMITED (hereinafter "We", "Us", "Our", or the "Service Provider"). By accessing or using the Application, you ("User" or "You") acknowledge that You have read, understood, and agree to be bound by these Terms of Use ("Terms"), as well as Our Privacy Policy. If You do not agree to these Terms, please do not use the Application.

1. Beta Status and Evolving Service

The Application is currently in a beta stage of development and is part of a small startup initiative. As such, features, functionality, and overall service quality may change, evolve, or be removed at any time without prior notice. We may introduce experimental features and functionality, and certain aspects of the Application may be unstable, contain errors, or not function as intended. By using the Application during its beta phase, You acknowledge and accept these risks.

2. Eligibility and User Representations

To use the Application, You must be at least 13 years old. If You are under the age of majority in your jurisdiction, You represent and warrant that You have obtained the necessary consent from a parent or legal guardian to use the Application and to be bound by these Terms. By using the Application, You represent and warrant that:

• You are at least 13 years of age and have the legal capacity to enter into these Terms.
• You will comply with all applicable laws, regulations, and these Terms when accessing or using the Application.

3. Account Registration and Security

Certain features of the Application may require You to create an account. When creating an account, You agree to provide accurate, current, and complete information and to keep such information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If You suspect any unauthorized use of your account, You agree to notify Us immediately.

4. License and Permitted Use

Subject to these Terms, We grant You a non-exclusive, non-transferable, revocable license to access and use the Application for personal, non-commercial purposes. You agree to use the Application only as intended and in compliance with all applicable laws and regulations.

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Application for any illegal purpose or in violation of any local, state, national, or international laws.
• Posting, uploading, or distributing content that is unlawful, defamatory, obscene, harassing, threatening, abusive, invasive of privacy, or otherwise objectionable.
• Interfering with or disrupting the operation of the Application, servers, or networks connected to the Application.
• Exploiting or harming children by exposing them to inappropriate content or asking for personal data.
• Attempting to gain unauthorized access to the Application, other user accounts, or computer systems or networks connected to the Application.
• Using the Application to distribute unsolicited commercial communications ("spam").
• Reproducing, distributing, modifying, creating derivative works of, publicly displaying, publicly performing, republishing, downloading, storing, or transmitting any of the materials on the Application, except as explicitly permitted by these Terms.

6. User-Generated Content

The Application may allow You to submit, post, upload, or otherwise make available content such as comments, photos, itinerary details, or other materials ("User Content"). You retain ownership of any intellectual property rights that You hold in that User Content.

By submitting User Content, You grant Us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, modify (for formatting or display purposes), publicly display, and publicly perform the User Content in connection with providing and improving the Application. You represent and warrant that You have the rights to grant this license and that the User Content does not violate these Terms or any third-party rights.

7. Intellectual Property

All intellectual property rights in the Application and its content (including but not limited to text, graphics, logos, icons, images, software, and trademarks) are owned by Us or Our licensors and are protected by applicable intellectual property laws. Except as expressly permitted by these Terms, You may not use, reproduce, modify, distribute, or create derivative works of any part of the Application without Our prior written consent.

8. Third-Party Links and Services

The Application may contain links to third-party websites, products, or services that are not owned or controlled by Us. We do not endorse or assume any responsibility for such third-party content. Your interactions with third-party services are solely between You and the third party. We encourage You to review the terms and conditions of any third-party service before using it.

9. Termination

We may terminate or suspend your account and access to the Application at any time, without prior notice, for any reason, including if You breach these Terms. Upon termination, all licenses and rights granted to You under these Terms will immediately cease. Sections that by their nature should survive termination will continue in full force and effect.

10. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APPLICATION IS AT YOUR OWN RISK, ESPECIALLY DURING THE BETA PHASE WHEN FEATURES MAY BE EXPERIMENTAL AND UNSTABLE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APPLICATION, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Us, Our affiliates, and our respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) arising out of or related to:

• Your access to or use of the Application.
• Your violation of these Terms or any applicable law or regulation.
• Your violation of any third-party right, including intellectual property or privacy rights.
• Any User Content You submit that causes damage to a third party.

13. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which PIRTZTEL TECHNOLOGIES PRIVATE LIMITED is incorporated, without regard to its conflict of law provisions. Any dispute arising from these Terms or the use of the Application shall be resolved in the courts of that jurisdiction. You consent to the exclusive jurisdiction and venue of such courts.

14. International Use

We make no representation that the Application is appropriate or available for use in locations outside your country of residence. Accessing the Application from territories where its content or functionality is illegal or prohibited is at your own risk. You are responsible for compliance with all local laws.

15. Changes to the Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will provide at least 30 days' notice prior to the new terms taking effect. By continuing to access or use the Application after the revisions become effective, You agree to be bound by the updated Terms. If You do not agree to the new terms, please discontinue using the Application.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid or enforceable. The remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by Us in the Application, constitute the entire agreement between You and Us regarding the Application and supersede any prior agreements.

18. Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver shall be effective only if in writing and signed by an authorized representative of PIRTZTEL TECHNOLOGIES PRIVATE LIMITED.

19. Assignment

We may assign or transfer these Terms, in whole or in part, without restriction. You may not assign or transfer any rights or obligations under these Terms without Our prior written consent.
