  • House Bill 957: Relates to requirements for the physical presence of a borrower for signing certain documents related to a home equity loan.

  • Senate Bill 1059: Relates to the presumption of validity for an advance directive and permissible forms of a medical power of attorney.

  • House Bill 1976: Relates to the establishment of a program for the issuance of digital identification

Physical Presence for Signing a Home Equity Loan Relates to requirements for the physical presence of a borrower for signing certain documents related to a home equity loan.
Analysis (as introduced): 1. Permits certain borrowers, as specified, to close a home equity loan from a remote location using remote online notarization.
2. Takes effect January 1, 2026, if the constitutional amendment authorizing the legislature to provide exceptions to the requirement that a home equity loan be closed only at the office of the lender, an attorney at law, or a title company is approved by the voters.

Medical Power of Attorney
Relates to the presumption of validity for an advance directive and permissible forms of a medical power of attorney.
Analysis (as introduced): 1. Provides that a valid medical power of attorney under Health and Safety Code 166.163 must be acknowledged before a Notary Public.
2. Takes effect September 1, 2025.

Digital Identification
Relates to the establishment of a program for the issuance of digital identification.
Analysis (as introduced): 1. Defines "digital identification" to include a digital driver's license, a digital personal identification certificate, a digital handgun license, a digital hunting or fishing license, and a digital license issued by the Department of Public Safety under Chapter 1702, Occupations Code.
2. Requires the Department of Public Safety, in consultation with the Parks and Wildlife Department, by rule to establish a program for the issuance of digital identification.
3. Defines the duties, as specified, for the Department of Public Safety, in adopting rules for digital identification.
4. Takes effect September 1, 2025.
