Compliance Update: FTC Non-Compete Ban Dismissed

On September 5, 2025, the Federal Trade Commission (FTC) officially dropped its efforts to implement a nationwide ban on non-compete agreements. This means employers no longer need to prepare for a federal rule restricting non-competes.

However, Alabama law still governs how and when non-competes can be used. Here’s what you need to know:

  • Non-competes are generally enforceable in Alabama if they protect a legitimate business interest and are reasonable in duration, geographic scope, and the type of work they restrict.

  • Two years or less is typically considered a reasonable time limit, assuming the agreement is otherwise fair and tied to a legitimate business interest.

  • Certain professionals, including attorneys, physicians, accountants, veterinarians, and physical therapists, cannot be bound by non-competes under Alabama law.

  • Low-wage workers who don’t have access to confidential information are unlikely to be subject to enforceable non-competes.

  • No wage threshold or notice requirements currently apply in Alabama.

  • Non-competes must be with active employees, not prospective hires.

What this means for you:

  • You can continue using non-compete agreements in Alabama, but they must meet state-specific requirements.

  • It’s more important than ever to review your agreements for compliance with Alabama law.

  • The FTC may still investigate non-competes on a case-by-case basis, especially in industries like healthcare and staffing.
