Terms of Use

These Terms of Use (“Terms”) govern the relationship between the user (hereinafter referred to as “User”) and Joyce Studios (hereinafter referred to as “Company”) regarding the use of the mobile application "Sleep Frequency App" (hereinafter referred to as “App”).
By installing or using the App, the User agrees to be bound by these Terms. If the User does not agree, they must refrain from installing or using the App.

1. Overview of Services

The App provides various audio content designed to assist with sleep and relaxation. The main features include:

• Delta wave-based frequency sounds
• Natural ambient sounds (e.g., rain, ocean waves, birdsong)
• Sleep music and meditation background audio

This App is intended as a wellness aid for mental relaxation and is not a medical device or treatment tool. It does not diagnose, cure, treat, or prevent any medical condition, nor does it guarantee any therapeutic effects.

2. Eligibility and User Responsibility

• The App is available to individuals aged 14 and older.
• Users under the age of 14 must obtain prior consent from a legal guardian before using the App.
• This App is not a substitute for medical advice. Users with sleep disorders, mental health conditions, or other health issues must consult a qualified professional before using the App.
• Users are solely responsible for any effects or side effects resulting from the use of the App.
• Do not use the App while driving, operating machinery, or during activities requiring full concentration. The Company shall not be liable for any accidents or damage resulting from such use.

3. Intellectual Property Rights

All content within the App—including audio files, text, code, UI elements, and images—is the intellectual property of the Company or licensed from third parties and is protected under copyright laws and international treaties. Users may not:

• Reproduce, distribute, transmit, publicly display, modify, or create derivative works without prior written consent from the Company
• Use any content for commercial purposes without authorization
• Use scraping tools or automated means to extract or duplicate content

Unauthorized use may result in civil or criminal penalties.

4. Collection and Use of Personal Information

To improve service quality and provide push notifications, the App may collect limited, non-identifiable information, including:

• Device identifier and FCM (Firebase Cloud Messaging) token
• Usage patterns, playback data, and session statistics

Collected data is anonymized and used solely for the following purposes:

• Improving app performance and stability
• Sending push notifications
• Statistical analysis of usage trends

All data handling is conducted in accordance with applicable data protection laws. The Company employs appropriate technical and administrative safeguards to protect user information.

5. Service Changes and Disruptions

The Company reserves the right to change, suspend, or discontinue part or all of the App services without prior notice for reasons such as:

• App or content updates
• Internal policy decisions or business considerations
• Unavoidable circumstances including system failures or natural disasters

The Company shall not be held liable for any damages arising from such changes unless otherwise required by law.

6. Advertisements and External Links

The App may include advertisements or external links (e.g., YouTube, Spotify, App Store). These third-party services are beyond the Company’s control, and the Company assumes no responsibility for the content, security, or practices of external websites.

• Users access external links at their own risk.
• The Company bears no liability for any loss or damage resulting from interactions with third-party content.

7. Limitation of Liability

• The App is designed to assist with relaxation and sleep but does not guarantee specific outcomes such as rapid sleep induction or sustained deep sleep.
• Performance may vary depending on the user's device, OS version, settings, and network conditions.
• The Company is not liable for any issues or losses arising from factors outside its control, or from the User’s misuse or negligence.

8. Changes to the Terms

• The Company may update these Terms in accordance with changes in relevant laws or service improvements.
• Users will be notified of such updates via in-app announcements or app store updates.
• If a User does not agree to the revised Terms, they must stop using and uninstall the App. Continued use constitutes acceptance of the updated Terms.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Korea. Any disputes arising from or relating to the App shall be subject to the exclusive jurisdiction of the courts located in the Company's principal place of business in Korea.
