This Privacy Policy explains how The Adept AS ("Binaura," "we," "us," or "our") collects, uses, shares, and protects information when you use the Binaura mobile application (the "App") and any related services (collectively, the "Service"). By using Binaura, you agree to the practices described below.
Plain-English summary. We collect the minimum data needed to deliver a personalized binaural sleep protocol: your account identifier, your onboarding answers, your session history, and basic device/diagnostic data. We do not sell your personal information. We do not use your audio sessions to advertise to you. You can delete your account at any time from inside the App.
1. Information we collect
1.1 Information you provide
Account information. When you sign in with Apple, we receive a unique anonymized Apple user identifier and, optionally, your name and a relay email address (if you choose to share it).
Onboarding answers. Your responses to our brief questionnaire (sleep goals, sleep struggles, age range, daily schedule, commitment timeline) used solely to personalize your protocol.
Reminder preferences. If you opt in to a daily reminder, we store the time you selected on your device and schedule a local notification.
Customer support communications. If you email us, we'll have a record of that correspondence.
1.2 Information generated through use of the App
Session data. Start time, duration, configuration (carrier frequency, ramp, target frequency, pink noise on/off), and completion status of each binaural session.
Streaks and aggregate stats. Derived counters used to display your progress in-app.
Subscription state. Whether you are on a free trial, active subscription, or expired — provided to us by Apple's StoreKit. We never see or store your payment card details.
1.3 Information collected automatically
Device and diagnostic data. Device model, iOS version, App version, language/region, anonymous installation identifier, crash logs, and basic performance metrics.
Analytics events. Aggregated, pseudonymous events such as "session started," "onboarding completed," or "paywall viewed" — used only to understand how the App is performing.
We do not record audio from your microphone, access your contacts, photos, calendar, or Health/HealthKit data, or track you across other companies' apps and websites.
2. How we use your information
To deliver and personalize the binaural protocol you came for.
To save your settings, sessions, and progress across devices.
To send the local reminder notifications you opted in to (these are scheduled on your device and do not leave it).
To process subscriptions, free trials, and refunds via Apple.
To diagnose crashes and improve App stability and performance.
To respond to support requests, abuse reports, or legal obligations.
To communicate important service updates (e.g., changes to this Policy).
We do not use your data for behavioral advertising and we do not sell or rent your personal information to third parties.
3. Legal bases (GDPR / EEA users)
If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process your personal data under the following legal bases:
Performance of a contract — to provide the App and your subscription.
Legitimate interests — to keep the App secure, prevent abuse, and improve the product. We balance these interests against your rights.
Consent — for optional features such as analytics or push notifications, where required by law.
Legal obligation — to comply with applicable laws.
4. How we share information
We share information only in the following limited circumstances:
Service providers. Vendors that host our infrastructure or process data on our behalf under written contracts (see Section 5).
Legal compliance. When required by law, court order, or governmental authority, or to protect the rights, safety, or property of Binaura, our users, or the public.
Business transfers. If Binaura is involved in a merger, acquisition, or asset sale, your information may be transferred — subject to the protections described here.
With your consent. Any other sharing will be with your explicit consent.
5. Third-party services we rely on
Apple, Inc. — Sign in with Apple authentication, App Store subscriptions, push notification delivery (APNs).
Apple Privacy Policy
These providers are contractually bound to process your data only on our instructions and to apply industry-standard safeguards.
6. Data retention
We retain your account, profile, onboarding answers, and session history for as long as your account is active. When you delete your account from within the App (Profile → Delete Account), we delete your data from our active production systems within 30 days. Backups are purged on a rolling basis within 90 days. Aggregated, de-identified statistics may be retained indefinitely for product analytics.
7. Security
We use encryption in transit (TLS 1.2+) and at rest, restricted access controls, App Check attestation to prevent unauthorized clients, and regular review of our security posture. No method of transmission or storage is 100% secure, but we work hard to protect your data and would notify affected users without undue delay in the event of a confirmed breach as required by applicable law.
8. Your rights and choices
Depending on your location you may have the right to:
Access a copy of the personal data we hold about you.
Correct inaccurate or incomplete data.
Delete your account and personal data (use the in-app "Delete Account" button or email us).
Restrict or object to certain processing.
Portability — request an export of your data in a machine-readable format.
Withdraw consent at any time, where processing is based on consent.
Lodge a complaint with your local data protection authority (in Norway, the Datatilsynet).
You can manage push notifications anytime in iOS Settings → Notifications → Binaura, and your subscription via Apple ID → Subscriptions.
9. Children's privacy
Binaura is not directed to children under the age of 13 (or the equivalent minimum age in your jurisdiction), and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it.
10. International data transfers
Binaura is operated from Norway. Your information may be processed in countries outside your own, including the United States (where some of our service providers operate). When we transfer personal data out of the EEA, the UK, or Switzerland, we rely on adequacy decisions, Standard Contractual Clauses, or other safeguards approved by the relevant authorities.
11. California privacy rights (CCPA / CPRA)
California residents have the right to know what personal information we collect, the categories of sources and recipients, and the right to request access, deletion, or correction of their personal information, and to be free from discrimination for exercising those rights. We do not sell or share personal information for cross-context behavioral advertising. To exercise your rights, contact us using the details below.
12. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we'll revise the "Last updated" date at the top and, if changes are material, we'll provide additional notice (for example, via the App or email). Your continued use of Binaura after changes become effective means you accept the revised Policy.
